Anyier Model Management (AMM) provide top tier talent across a range of different services, including Editorial models, Runway models, Commercial models, Sports & fitness models, and Brand ambassadors.

 

AMM represent talent across different ethnicities, ages, shapes, and sizes to allow the perfect fit for customers’ brand.

MODEL/CLIENT/ANYIER MODEL MANAGEMENT (AMM) RELATIONSHIP:

A model engages AMM to be their agent representative and AMM has their authority to enter into contracts with clients on their behalf. At no time do AMM enter into an employer/employee relationship with the models. The models are not contracted to AMM.

The client is defined as the “end-user” by the Australian Taxation Office (ATO) “PAYG withholding for performing artists” guidelines. AMM is an “intermediary” as defined in the ATO’s Superannuation Guarantee Ruling SGR 2005/2.

A contract is created between client and model once a booking is confirmed with AMM, whether written or oral, as stated by the ATO’s Superannuation Guarantee Ruling.

In accordance with the ATO’s “PAYG withholding for performing artists” guidelines, AMM is entitled to raise invoices and collect monies on behalf of the model, as an intermediary, even though the contract exists between client and model.

This document constitutes working terms & Conditions between ANYIER MANAGEMENT PTY LTD trading as license holder of Anyier Model Management (ABN 22 621 830 331) (Talent Management, Agency, Manager, We or Us) and YOU (Client, Company).

No variation or amendment to the terms of these terms and conditions shall be valid and binding unless in writing and signed by an authorised representative of each party.

AGENCY SERVICE FEE or “BOOKING FEE”

The “Agency Service Fee” or “booking fee” is a mandatory charge on all bookings made with the agency for all talent and is not a negotiable fee for the purposes of making a booking.

The agency service or service fee is calculated at 20% on the total of the job and loading for all jobs booked.

GST

GST will be charged at the Government set rate (currently 10%) on the Agency Service Fee only.

RATES 

Photographic rates are determined by image/ footage usage and therefore the client must advise exactly where images/ footage are being used at the time of booking in order to get an accurate quote.

Rates are quoted in Australian Dollars unless otherwise specified.

All rates are negotiated and agreed to by the client prior to the commencement date

All rates exclude GST

The client shall not attempt to negotiate, nor allow others to negotiate, with the models directly.

Additional rates such as overtime will be charged and included in the final invoice.

Travel or any other costs associated with each assignment example: hotel and flights, and transfers will be quoted separately.

Please check rates at the time of booking for video. For all videos, the normal daily rates will apply PLUS a buy-out to be negotiated.

Usage/loading rates are to be included within the final rate.

Nude, semi-nude, see-through, bathing suit or lingerie photography require the express prior written approval of the agency. The use of the model’s image must not be pornographic, derogatory, or a cause of ridicule or embarrassment to the model. The image must not be altered or distorted.

USAGE RIGHTS

Clients must advise exactly where images and/or footage will be used upon making their booking. Images and footage obtained at a booking can only be used for the agreed purpose (as outlined in the Booking Agreement.)

Clients must contact AMM if they decide to implement additional usage, and pay the difference owing. (They will be required to pay for the photographic rate that applies to their usage, minus what they have already paid.)

Use of the images or video footage, by way of (but not restricted to) Advertising, Swing Tags, Posters, Show Cards, Pack Shots, Billboards, Lightbox, Stills on TV, Pack Shots, Websites, Bus-Sides etc, must be discussed and authorised with AMM prior to the booking-taking place.

Some products are also likely to attract payment of higher fees, e.g. underwear, alcohol, hair and beauty products. Different types of usage will be negotiated separately, and images taken for one type of usage may not be used for another type of usage without prior negotiation.

Any image used without written authorisation or prior approval from AMM will be deemed as ‘unauthorised usage’ and will be subject to legal proceedings. In accordance with these terms and conditions, the client will be responsible to pay for all expenses and costs incurred in recovering any outstanding monies, including debt collection fees and solicitor’s costs.

In general, the confirmed booking and usage fees cover the right to use one image for a catalogue for one year from the shoot date, worldwide. Usage rights are not granted to the client until payment in full has been received.

Clients must contact AMM if they decide to use the images for longer than 12 months. Any further extension of usage or territory must be immediately notified to and negotiated with AMM.

HOURS BOOKED

The total hours that a model is booked for is the minimum hours that the model must be paid for. If a job finishes prior to the originally booked time, the model must be paid for the original hours booked regardless of whether the job was completed early.  If a job takes longer than the originally booked hours, then overtime will be charged at the applicable hourly rate.

A model must be paid from their call time, regardless of when hair and makeup start or when the shoot/ event starts.

OVERTIME

AMM will quote model rates on a per hour or full day rate. Overtime will be charged at the applicable hourly rate if the job runs 20 minutes overtime, constituting an additional hour to be charged.
